Tradesy may disclose Users’ personal information to the following parties and for the purposes for which it was collected as described above:
Sellers from whom you have purchased items
When you buy an item on Tradesy, if the seller does not elect to use her own shipping materials, the seller receives a Tradesy-branded shipping kit with a pre-paid, pre-addressed postage label with your full street address. The information will only include that which is necessary and relevant to successfully complete your order. The seller is strictly prohibited from using your information for anything other than completing the sale.
Business partners, trusted affiliates, and third party service providers
We may disclose generic aggregated demographic information not linked to any personal information regarding visitors and users with our business partners, trusted affiliates, and advertisers, without notification to the User of such disclosure. We may use third party service providers to help us operate our business and our Website or administer activities on our behalf, such as sending newsletters or surveys. We may disclose your information, including your personal information, to these third parties only to the extent necessary for them to provide such services to us and such third party service providers are contractually obligated to maintain the confidentiality and security of that information. These third parties may be located outside of your country of residence, including in Canada, Australia, or European Union (“Offshore Recipients”). In this case, your personal information would be subject to the laws of the country in which the Offshore Recipient is located, which may have laws that require that your personal information be disclosed to government agencies under different circumstances than would your country of residence. While Tradesy remains committed to protecting your personal information, you consent to this disclosure and acknowledge that Tradesy has no control over, and is not liable for, the acts and omissions of Offshore Recipients.
We may use personal information obtained when placing an order to provide service to that order, including for the purpose of order approval and fulfillment, fraud detection, and/or automated decision making. We may share this personal information with third-party payment providers, including but not limited to Stripe, PayPal, Riskified, and/or Affirm, to the extent necessary to provide or improve performance of the service.
Law enforcement and government agencies
We may disclose User’s personal information as required by law, including to law enforcement and government agencies in response to a verified request related to suspected illegal activities or related to a criminal investigation. We will only disclose information that we find necessary and relevant (“Disclosed Information“). Disclosed Information may include a User’s name, mailing address, phone number, and email address. Disclosure may be made without notice to User.
Third Parties with intellectual property rights

We may disclose User’s personal information to third parties involved in a legal proceeding if the third party provides Tradesy with a subpoena or other similar lawful process. Disclosure may be made without notice to User.
Tradesy will also disclose to third parties involved in a legal proceeding when Tradesy believes in good faith that disclosing personal information is necessary to prevent imminent physical harm or financial loss, or to report suspected illegal activity.
We may use user information obtained from account activity including total number of sales, last active timeframe, and message response time, in order to provide seller performance information to Tradesy users.

Storing Your Information
Tradesy will retain and store your personal information for as long as is necessary to provide you the Services and any other ancillary purposes. Following termination or deactivation of your account, Tradesy or its service providers may retain information (including your profile information) for a commercially reasonable time for backup, archival, and/or audit purposes. Tradesy adopts this California Privacy Notice to comply with the California Consumer Privacy Act of 2018 (“CCPA”), and any defined terms as used herein shall have the same meaning as defined terms in the CCPA.
Personal Information We Collect
Tradesy collects information that identifies, relates to, describes, references, is capable of being associated with, or could reasonably be linked with, directly or indirectly, a particular consumer or household (“personal information”). The CCPA refers to certain categories of information, which we have listed below and indicated whether or not we have collected personal information under those categories within the last twelve (12) months:

We obtain the above-listed categories of personal information from the following sources:
- Directly from you. For example, from forms you complete on our website; and
- Indirectly from you. For example, from observing your actions on our website or interactions with our advertisers.
Personal information does not include:
- Publicly available information from government records;
- Deidentified or aggregated consumer information; or
- Information excluded from the CCPA’s scope, like
- health or medical information covered by the Health Insurance Portability and Accountability Act of 1996 (HIPAA) and the California Confidentiality of Medical Information Act (CMIA) or clinical trial data;
- personal information covered by certain sector-specific privacy laws, including the Fair Credit Reporting Act (FRCA), the Gramm-Leach-Bliley Act (GLBA) or California Financial Information Privacy Act (FIPA), and the Driver’s Privacy Protection Act of 1994.

We may use, or disclose to a third party (including service providers and third parties to whom you or your agents authorize us to disclose your personal information in connection with Services we provide to you), your personal information for business or commercial purposes. Your Privacy Rights and Choices
If you are a consumer as defined by the CCPA, you have specific rights in connection with your personal information:
Right to Request Personal Information Collected
If we collect personal information about you, you have the right to request that we disclose to you certain information about our collection and use of your personal information over the past twelve (12) months. Once we receive and verify your consumer request, we will disclose to you:
- The categories of personal information we have collected about you;
- The categories of sources from which the personal information about you is collected;
- The business or commercial purpose for collecting or selling personal information;
- The specific pieces of personal information we have collected about you (also called a “data portability request”);
- The categories of third parties with whom we share personal information; and
- If we disclosed or sold your personal information to a third party for a business purpose:
- If disclosed, a list identifying the personal information categories that each category of recipient obtained; and
- If sold, a list identifying the personal information categories that each category of recipient purchased.
Right to Request Deletion
You have the right to request that we delete any of your personal information that we collected from you and retained, subject to certain exceptions set forth below. Once we receive and verify your consumer request, we will delete (and direct our service providers to delete) your personal information from our records, unless an exception applies.
We may deny your deletion request if retaining the information is necessary for us or our service providers to:
- Complete the transaction for which we collected the personal information, provide a good or service that you requested, take actions reasonably anticipated within the context of our ongoing business relationship with you, or otherwise perform our contract with you;
- Detect security incidents, protect against malicious, deceptive, fraudulent, or illegal activity, or prosecute those responsible for such activities;
- Debug products to identify and repair errors that impair existing intended functionality;
- Exercise free speech, ensure the right of another consumer to exercise their free speech rights, or exercise another right provided for by law;
- Comply with the California Electronic Communications Privacy Act (Cal. Penal Code § 1546 seq.);
- Engage in public or peer-reviewed scientific, historical, or statistical research in the public interest that adheres to all other applicable ethics and privacy laws, when the information’s deletion may likely render impossible or seriously impair the research’s achievement, if you previously provided informed consent;
- Enable solely internal uses that are reasonably aligned with consumer expectations based on your relationship with us;
- Comply with a legal obligation; or
- Otherwise use your personal information internally in a lawful manner that is compatible with the context in which you provided it.
Right Not to Be Discriminated Against
You have the right to not be discriminated against by a business for exercising any of your rights under the CCPA. Unless permitted by the CCPA, we will not:
- Deny goods or Services to you;
- Charge you different prices or rates for goods or Services, including through the use of discounts or other benefits or imposing penalties;
- Provide a different level or quality of goods or Services to you; or
- Suggest that you will receive a different price or rate for goods or Services or a different level or quality of goods or Services.
How to Exercise Your Rights
Upon receipt of a verifiable request from you to access or delete your personal information we shall promptly take steps to disclose and deliver or delete as applicable, free of charge to you, the personal information in accordance with Cal. Civil Code §1798.100 (d). Please note that only you, or a person registered with the California Secretary of State that you authorize to act on your behalf, may make a verifiable consumer request related to your personal information. You may also make a verifiable consumer request on behalf of your minor child. To be a verifiable consumer request, the request must:
- Provide information sufficient to allow us to reasonably verify you are the person about whom we collected personal information or an authorized representative; and
- Describe your request with detail sufficient to allow us to properly understand, evaluate, and respond to it.
We cannot respond to your request or provide you with personal information if we cannot verify your identity or authority to make the request and confirm the personal information relates to you. We will only use personal information provided in a verifiable consumer request to verify the requestor’s identity or authority to make the request.
Response Timing and Format
Upon receiving a verifiable request, we will confirm receipt of the request within ten (10) days and indicate when you should expect a response. We endeavor to respond to all verifiable requests within forty-five (45) days from the day that we receive the request. If we require additional time to respond to your request, we may take up to an additional forty-five (45) days to respond, in which case we will provide you with notice and an explanation for the delay.
We will deliver a written response by mail or electronically. Any disclosures we provide will only cover the twelve (12) month period preceding the verifiable consumer request’s receipt. The response we provide will also explain the reasons we cannot comply with a request, if applicable. For data portability requests, if provided electronically, the information shall be in a portable and, to the extent technically feasible, in a readily useable format that allows you to transmit this information to another entity without hindrance.
Please note that while we may provide personal information to you in response to your verifiable request, we are not required to provide personal information to you more than twice in a twelve (12) month period.
